Dans les Pyr\u00e9n\u00e9es-Atlantiques comme ailleurs, ces frais notariaux sont souvent peu clairs pour les acqu\u00e9reurs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Concr\u00e8tement, les frais de notaire se d\u00e9composent ainsi :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Les DMTO (droits de mutation \u00e0 titre on\u00e9reux)<\/b><b><br \/><\/b><span style=\"font-weight: 400;\">Ce sont les taxes revers\u00e9es \u00e0 l\u2019\u00c9tat et aux collectivit\u00e9s : d\u00e9partement, commune, et pr\u00e9l\u00e8vement de 2,37 % sur la part d\u00e9partementale. Part la plus lourde dans l\u2019ancien, nous verrons pourquoi plus bas.<\/span><span style=\"font-weight: 400;\">\n<p><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Les \u00e9moluments du notaire<\/b><b><br \/><\/b><span style=\"font-weight: 400;\">C\u2019est la r\u00e9mun\u00e9ration r\u00e9glement\u00e9e par un bar\u00e8me d\u00e9gressif issu du code du commerce (A444-91) : 3,870 % (0\u20136 500 \u20ac), 1,596 % (6 500\u201317 000 \u20ac), 1,064 % (17 000\u201360 000 \u20ac), <\/span><b>0,799 %<\/b><span style=\"font-weight: 400;\"> (&gt; 60 000 \u20ac).\u00a0<\/span><\/li>\n<\/ul>\n<p><i><span style=\"font-weight: 400;\">Le bar\u00e8me officiel des \u00e9moluments, issue du <\/span><\/i><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041684370\"><i><span style=\"font-weight: 400;\">Code de commerce.<\/span><\/i><\/a><\/p>\n<p><b>Astuce l\u00e9gale<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Une remise jusqu\u2019\u00e0 20 % peut s\u2019appliquer sur les \u00e9moluments du notaire pour la part du bien sup\u00e9rieure \u00e0 100 000 \u20ac. Elle n\u2019est ni automatique ni n\u00e9gociable individuellement : le notaire doit l\u2019avoir affich\u00e9e et propos\u00e9e \u00e0 tous ses clients.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Les d\u00e9bours<\/b><b><br \/><\/b><span style=\"font-weight: 400;\">Ce sont les frais avanc\u00e9s par l\u2019\u00e9tude pour les pi\u00e8ces et formalit\u00e9s (cadastre, urbanisme, SPF, copies, etc.). Ordre de grandeur : ~1 000\u20131 500 \u20ac selon les dossiers. Ce n\u2019est pas une taxe \u00e0 proprement parler.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>La CSI (0,10 %)<\/b><b><br \/><\/b><span style=\"font-weight: 400;\">C\u2019est une taxe d\u2019\u00c9tat minimale de 15 \u20ac, due \u00e0 la publicit\u00e9 fonci\u00e8re (vente et, le cas \u00e9ch\u00e9ant, inscription de garantie hypoth\u00e9caire\/PPD).<\/span><\/li>\n<\/ul>\n<p><b>DMTO 2025 : La vague des d\u00e9partements \u00e0 5 %<\/b><\/p>\n<p><span style=\"font-weight: 400;\">La hausse du taux de taxe d\u00e9partementale a \u00e9t\u00e9 <\/span><b>un mouvement massif au printemps.<\/b><span style=\"font-weight: 400;\"> D\u00e8s Avril\u2013Mai, <\/span><b>plusieurs dizaines de d\u00e9partements<\/b><span style=\"font-weight: 400;\"> ont adopt\u00e9 la hausse, <\/span><b>46 d\u00e9partements \u00e0 5 % au 1\u1d49\u02b3 mai<\/b><span style=\"font-weight: 400;\">, notamment, Paris 75, Rh\u00f4ne 69, Haute-Savoie 74, Pyr\u00e9n\u00e9es-Orientales 66, etc. <\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">D\u2019autres ont suivi en juin.<\/span><\/p>\n<h2><b>Ancien vs neuf : Deux logiques fiscales distinctes<\/b><\/h2>\n<h3><b>Dans l\u2019ancien\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Pas de TVA ; on applique les DMTO complets. Avec la part d\u00e9partementale \u00e0 5 %, on obtient un taux de taxes ~6,32 %. En ajoutant \u00e9moluments, d\u00e9bours et CSI, comptez ~7\u20138 % du prix.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/p>\n<h3><b>Dans le neuf (VEFA ou &lt; 5 ans)\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">La vente est soumise \u00e0 la TVA (20 %) ; les droits de mutation \u00ab classiques \u00bb sont remplac\u00e9s par une TPF all\u00e9g\u00e9e autour de 0,715 % (0,70 % d\u00e9pt + 2,14 % de frais d\u2019assiette sur cette part).
